Terms of Sale & Website Use

These terms govern merchandise purchases from the Rockway Shop and use of this website.

1. Scope and incorporated policies

These Terms apply to merchandise purchased through the Rockway Shop and to use of this website. They incorporate the Refund Request, Return and Cancellation Policy, Shipping and Delivery Policy, and product-specific details shown before payment. Puppy applications, deposits, reservations, guardian arrangements, and puppy purchases are not shop merchandise orders and require a separate written agreement where applicable.

2. Capacity and checkout acceptance

To place an order, you must be at least the age of majority where you live and capable of entering a binding agreement. A parent or legal guardian should place an order for a minor. Before secure payment, you can review and correct the bag, contact information, delivery address, shipping charge, estimated or final tax, total, and applicable policies. The required policy checkbox starts unchecked. Selecting it and completing the final order action records your acceptance of the version identified at checkout.

3. Products, availability, and order formation

Rockway aims to keep product descriptions, images, materials, sizes, care details, and availability accurate. Screen settings and the nature of printed or handmade goods can cause minor non-material variations. An order is subject to inventory and checkout validation. The sales agreement is formed when payment is confirmed and Rockway sends an order confirmation. If an item cannot be supplied after payment, Rockway will contact you and provide the remedy required by law, which may include a refund.

4. Prices, currency, tax, shipping, and payment

All shop amounts are in Canadian dollars (CAD). The advertised product price does not include shipping or applicable tax. Both are itemized during checkout before the order is placed. Canadian tax is calculated using the confirmed transaction information. Rockway does not add an undisclosed carrier or handling fee. If an address cannot be served on the disclosed terms, the order will not be accepted and no payment will be taken. Payment is made through secure hosted payment fields; Rockway does not receive or store complete card numbers.

5. Discounts

A discount is subject to its stated eligibility, dates, limits, and available redemptions. Unless Rockway expressly says otherwise, discounts cannot be combined, have no cash value, and do not reduce tax where the law requires tax on another amount. A discount affected by an obvious technical or pricing error may be declined before an order is formed.

6. Delivery

Rockway ships to supported Canadian addresses using Standard shipping. The checkout and confirmation identify the delivery destination, charge, service, and available delivery estimate. Estimates are not guarantees unless expressly identified as guaranteed. Please review the Shipping and Delivery Policy for address corrections, delays, lost parcels, and delivery assistance. Mandatory cancellation or delivery rights under applicable law continue to apply.

7. Refund, return, cancellation, and exchange requests

Except where applicable law requires a cancellation, refund, repair, replacement, or other remedy, all sales are final and any request for a refund, return, cancellation, exchange, store credit, or other assistance is reviewed individually. Submitting a request is not approval and does not guarantee a discretionary remedy. The complete process and conditions are in the Refund Request, Return and Cancellation Policy.

8. Product quality, safety, and mandatory rights

Nothing in these Terms excludes or limits goods matching their description, applicable quality or fitness obligations, product-safety duties, or any cancellation, refund, repair, replacement, damage, or other right that cannot lawfully be excluded. If a product is incorrect, damaged, defective, recalled, materially different from its description, or not delivered, contact Rockway promptly. See the Product Safety and Recall Policy for safety concerns.

9. Website use and intellectual property

Website text, branding, original photography, artwork, and design are owned by Rockway or used with permission and are protected by applicable law. You may use the site for lawful, personal shopping and information. Do not attempt unauthorized access, interfere with the site or checkout, submit fraudulent information, scrape protected content at a disruptive rate, introduce malicious code, or impersonate another person.

10. Availability and limited liability

Rockway works to keep the website available and accurate but does not promise uninterrupted access. Only to the maximum extent permitted by applicable law, Rockway is not responsible for indirect or consequential loss caused solely by temporary website unavailability or misuse of the site. Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, a privacy or product-safety obligation, or any warranty, right, remedy, or liability that cannot lawfully be excluded or limited.

11. Events outside reasonable control

Rockway is not responsible for delay caused by an event genuinely outside its reasonable control, but will communicate known material delays and provide any cancellation, refund, or other remedy required by applicable law. This section does not shift responsibilities that the law places on Rockway.

12. Governing law, severability, and changes

These Terms are governed by the laws of Ontario and the applicable laws of Canada. A consumer keeps any mandatory protection of the province or territory where they live. Ontario courts have jurisdiction, subject to any forum right that cannot lawfully be limited. If a term is unenforceable, it will be limited or severed only as necessary and the remaining terms continue. Material changes apply prospectively; the policy version accepted with an existing order continues to govern that order.
